Agreement to Terms
By accessing or using 2ndchair.net, getafaircase.com, or any related services operated by Second Chair LLC (“Second Chair”), you agree to be bound by these Terms of Service. If you do not agree, do not use our sites or submit any information through our forms.
Who This Agreement Covers
These terms apply to two groups of users:
- Consumers (claimants) — individuals who submit information through our intake forms on Fair Case (getafaircase.com) seeking a connection with a personal injury attorney
- Attorney partners — law firms or attorneys who apply to receive leads through Second Chair's attorney application process
These terms also apply to any visitor browsing 2ndchair.net or getafaircase.com.
Consumer Services
Second Chair operates consumer-facing advertising under the brand Fair Case. When you submit an intake form, we collect information about your injury and contact details and match you with a single personal injury attorney partner in your market.
Second Chair is not a law firm. We do not provide legal advice, legal representation, or any legal services. Submitting an intake form does not create an attorney-client relationship between you and Second Chair. An attorney-client relationship may only be formed between you and the attorney partner you are connected with, subject to that firm's own terms and evaluation.
Attorney Partner Services
Second Chair delivers exclusive, TCPA-compliant personal injury leads to attorney partners on a per-market basis. By applying through our attorney application form, you express interest in receiving leads. Acceptance into the program and the specific terms of lead delivery, pricing, and exclusivity are governed by a separate partnership agreement executed between Second Chair and the attorney partner.
TCPA Consent
By submitting an intake form through Fair Case, you provide explicit consent under the Telephone Consumer Protection Act (TCPA) to be contacted by the specific attorney partner named in the consent disclosure. This consent is:
- One-to-one — naming a single, specific law firm
- Timestamped and recorded at the moment of submission
- Documented via a TrustedForm certificate generated by ActiveProspect
You may be contacted by phone, text message, or email by the named attorney partner. You are not required to provide consent as a condition of purchasing any goods or services.
No Legal Advice
Nothing on 2ndchair.net, getafaircase.com, or in any communication from Second Chair constitutes legal advice. Any information provided — including estimated case values, descriptions of legal processes, or general information about personal injury claims — is for informational purposes only and should not be relied upon as legal counsel.
You should consult directly with a licensed attorney for advice about your specific situation.
Accuracy of Information
You are responsible for providing accurate and truthful information when using our services. Second Chair reserves the right to reject, disqualify, or discard any submission that contains false, misleading, or fraudulent information.
Intellectual Property
All content on 2ndchair.net and getafaircase.com — including text, graphics, logos, images, video, advertising creative, and site design — is the property of Second Chair LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any of our content without prior written permission.
Prohibited Use
You agree not to:
- Scrape, crawl, or use automated tools to extract data from our sites
- Submit automated, bot-generated, or fraudulent intake form submissions
- Submit false or fabricated injury claims
- Interfere with the operation, security, or availability of our sites or services
- Use our services for any purpose that violates applicable law
Limitation of Liability
Second Chair connects consumers with attorney partners. We are not responsible for the conduct, performance, or outcomes of any attorney-client relationship that results from our services. We make no guarantees regarding case outcomes, settlement amounts, or the quality of legal representation provided by any attorney partner.
To the fullest extent permitted by law, Second Chair LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our sites or services.
Indemnification
You agree to indemnify and hold harmless Second Chair LLC, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these terms, or your submission of false or misleading information.
Termination
Second Chair reserves the right to terminate or restrict your access to our sites and services at any time, for any reason, without notice. This includes the right to refuse or disqualify submissions and to decline attorney partnership applications.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the state or federal courts located in California.
Changes to These Terms
We may update these Terms of Service from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continued use of our sites or services after changes are posted constitutes acceptance of the updated terms.
