Who We Are

Second Chair LLC (“Second Chair”) is a personal injury lead generation company. We operate two sides of a single business: on the consumer side, we run advertising campaigns under the brand Fair Case (getafaircase.com) to reach people who have been injured and may need legal representation. On the attorney side, we partner directly with personal injury law firms to deliver those leads — one firm per market, exclusively.

This policy covers data collected across both sides: the consumer intake funnel and the attorney partner application.


What We Collect — Consumers (Claimants)

When you submit an inquiry through our consumer intake form (Fair Case), we collect the following information:

  • Intake form responses — injury type, how recently the accident occurred, whether you've received medical treatment, your position on fault, severity of injury, and your contact information (name, phone number, email)
  • TCPA consent — explicit consent to be contacted, with a timestamp recording when consent was given
  • TrustedForm certificate — a third-party consent verification record generated by ActiveProspect at the time of submission
  • UTM parameters — campaign, source, medium, and content tags that tell us which ad brought you to the form
  • Session metadata — referring URL, landing page, and session duration
  • Behavioral signals — bot detection and form interaction patterns used to verify you are a real person
  • IP address
  • Device and browser information — browser type, operating system, screen resolution

What We Collect — Attorney Partners

When you apply to become a Second Chair attorney partner, we collect:

  • Firm name
  • Market(s) served
  • Contact name
  • Email address
  • Phone number

This information is submitted voluntarily through our attorney application form.


What We Collect — Site Visitors

When you visit 2ndchair.net, we collect standard analytics data: cookies, page views, device information, and IP address. We do not place tracking pixels from third-party advertising networks on the Second Chair website.


How We Use Your Information

Consumer data is used to:

  • Match you with a single attorney partner in your market
  • Verify lead quality and ensure compliance with advertising and consent regulations
  • Generate and retain TrustedForm consent records

Attorney partner data is used to:

  • Evaluate partnership fit
  • Communicate about our services and lead delivery

Site visitor data is used to improve the website experience and understand how visitors interact with our content.


How We Share Your Information

Consumer leads are delivered to one attorney partner only — the firm assigned to that market. We never share, resell, or distribute your information to multiple firms or lead buyers.

  • TrustedForm (ActiveProspect) — consent certification data is shared with ActiveProspect to generate and store TrustedForm certificates
  • DNC screening — phone numbers are screened against the Do Not Call registry via dnc.com

We do not sell your data to third parties. We do not work with data brokers. We do not share your information with anyone beyond the single attorney partner you are matched with and the compliance services listed above.


TCPA Consent & Compliance

Every consumer submission through our intake form includes explicit TCPA consent. This consent is:

  • One-to-one — naming a specific law firm as the party authorized to contact you
  • Timestamped at the moment of submission
  • Verified by a TrustedForm certificate generated and retained by ActiveProspect
  • Court-admissible consent documentation

We do not use blanket or multi-party consent. Each lead's consent names the specific firm that will receive it.


Data Retention

  • Lead data — retained for compliance and legal defense purposes for as long as reasonably necessary to support the attorney partner's records and any potential regulatory inquiry
  • TrustedForm certificates — retained per ActiveProspect's standard retention policy
  • Analytics data — retained per standard industry periods

Your Rights

You have the right to access, correct, or delete your personal data. To exercise any of these rights, email us at sasha@2ndchair.net.

California residents: Under the California Consumer Privacy Act (CCPA), you have additional rights including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of personal information. We do not sell personal information.

Residents of other states with applicable privacy laws may have similar rights. Contact us at the address above and we will respond in accordance with the law in your jurisdiction.


Cookies & Tracking

We use cookies for basic site functionality and analytics. These include session cookies, analytics cookies to understand page views and visitor behavior, and TrustedForm's script for consent certification on intake forms.

You can disable cookies through your browser settings. Disabling cookies may affect your experience on the consumer intake form but will not affect your ability to browse the Second Chair website.


Security

We protect your data using encryption in transit and at rest, role-based access controls, and row-level security policies on our database. Access to lead data is restricted to authorized personnel and the specific attorney partner the lead is delivered to.


Children's Privacy

We do not knowingly collect personal information from anyone under the age of 18. If you believe we have collected data from a minor, please contact us at sasha@2ndchair.net and we will promptly delete it.


Changes to This Policy

We may update this privacy policy from time to time. When we do, we will revise the “Last updated” date at the top of this page. We encourage you to review this policy periodically.
